Proposed Rule Changes to Continuing Education Requirements for Nursing Home Administrators - On June 2, 2015, the Board of Nursing Home Administrators issued a notice of proposed rule development to update and clarify requirements regarding continuing education for licensure renewal, criteria for approved continuing education courses, and requirements for approved providers of continuing education. A hearing will be held if requested within 21 days (June 23, 2015) of the publishing of the proposed rule notice. The proposed rule changes apply to rules number: 64B10-15.001 – Continuing Education for Licensure Renewal; 64B10-15.002 – Criteria for Approved Continuing Education; and 64B10-15.0021 – Approved Providers.

Summary of Rule Changes

Although there has been substantial rewording and combining of Rule 64B-15.001 and 64B-15.002, there were only 3 significant additions. These additions are as follows:

Under rule 64B10-15.001 (2) the sentence “A contact hour shall consist of fifty (50) clock minutes.” was added.

Under rule 64B10-15.001(2)(d) the sentence “Beginning October 1, 2016, a licensee shall have a minimum of two (2) contact hours of continuing education on Florida laws and rules relating to the practice of Nursing Home Administration.” was added.

Under rule 64B10-15.002(5) the sentence “Providers, and licensees who self-submit continuing education hours earned, shall identify the course type as described in Rule 64B10-15.001(2).” was added.

The only additions to 64B10-15.0021 were references to definitions found in other rules. An example of this is found in rule 64B10-15.0021. (1)(c) where the domain(s) of practice rule location is added.

Acceptable Version of the 3008 Form is Dated May 2009 - The Agency for Health Care Administration is in the process of revising the Medical Certification for Nursing Facility/Home and Community-Based Services form (AHCA MedServ-3008 form, May 2009), commonly known as the 3008. In addition to updating the form itself, the name of the 3008 form is changing to the Medical Certification for Medicaid Long-term Care Services and Patient Transfer Form (AHCA Form 5000-3008). The revised form will be incorporated into a new rule (Rule 59G-1.045).

The CARES program cannot accept the revised 3008 form numbered AHCA Form 5000-3008 until the new rule is final. Until the rule is final, the CARES program can only accept the 3008 form that is numbered AHCA MedServ-3008 and dated May 2009.
